1. GENERAL TERMS

These Terms and Conditions of Sale ("Terms") govern purchases made through the BRYDER website at www.bryderstudio.com (the "Website").

By placing an order through the Website, you agree to be bound by these Terms.

2. ORDERING AND AVAILABILITY

We make every reasonable effort to display the colours, details, measurements and appearance of our products as accurately as possible.

However, colours may appear differently depending on your device, monitor or screen settings, and we cannot guarantee that the colour displayed on your device will accurately reflect the actual colour of the product.

2.2 Product Availability

All products are subject to availability.

While we make reasonable efforts to keep the Website and product availability information up to date, we cannot guarantee that products displayed on the Website will remain available at the time you place your order.

If a product you have ordered becomes unavailable, we will contact you and provide an appropriate refund for any amount paid for the unavailable product.

2.3 Prices

Product prices are displayed in the currency applicable to your location or the currency selected on the Website. Prices may therefore be displayed in GBP, USD, EUR or other currencies supported by the Website.

The price and currency applicable to your order will be the price and currency displayed at checkout before you complete your purchase.

We aim to dispatch orders promptly.

Any delivery dates or delivery times provided are estimates unless we have expressly agreed a specific delivery date with you.

Delivery may take longer during sale periods, product launches, public holidays or other periods of unusually high demand.

If circumstances arise that significantly delay delivery, we will take reasonable steps to keep you informed.

4.3 Delivery Information

You are responsible for providing accurate and complete delivery information when placing your order.

If incorrect or incomplete information provided by you causes a delivery failure or additional delivery costs, you may be responsible for reasonable additional costs where permitted by law.

4.4 Uncollected or Undeliverable Packages

If a parcel cannot be delivered because you have provided incorrect delivery information, refused delivery, or failed to collect a parcel from a designated collection point after being notified, the parcel may be returned to us.

Where a parcel is returned to us in these circumstances, we will contact you regarding the available options.

Any additional delivery costs arising from incorrect information or failure to collect a parcel may be charged where permitted by law.

4.5 International Orders and Import Duties

Customers ordering products for delivery outside the United Kingdom may be responsible for import duties, customs charges, taxes or other fees imposed by the destination country, unless the applicable charges are expressly included in the order at checkout.

The customs and import rules of each destination country vary.

You are responsible for complying with applicable import requirements in the destination country and for paying any charges that are not collected by BRYDER at checkout.

Where applicable, we will provide the necessary customs and shipping documentation for your order.

We are not responsible for delays caused by customs authorities or for charges imposed by the destination country's authorities.

4.6 Risk and Delivery

For consumer purchases, the risk of loss or damage to the goods generally remains with BRYDER until the goods come into your physical possession or the physical possession of a person you have identified to take possession of them, except where applicable law provides otherwise.

Nothing in these Terms is intended to exclude or limit your statutory rights concerning delivery or the passing of risk.

5. RETURNS AND REFUNDS

5.1 Right to Cancel

If you are a consumer purchasing products online, you generally have the legal right to cancel your order within 14 days after the day on which you, or a person you identify to receive the goods, takes physical possession of the goods.

You do not generally need to provide a reason for exercising this statutory cancellation right.

You then generally have a further 14 days to return the goods to us.

5.2 Refunds

Where you validly exercise your statutory right to cancel, we will refund the relevant payment in accordance with applicable law.

This will generally include the cost of standard delivery. If you selected a more expensive delivery option, we are generally only required to refund the cost of the least expensive standard delivery option available.

We will generally issue the refund within 14 days of receiving the returned goods or, where permitted by law, receiving evidence that you have sent the goods back.

Refunds will normally be made using the original payment method.

5.3 Return Costs

Unless otherwise stated in our Returns Policy or required by law, you are responsible for the direct cost of returning goods following a change-of-mind cancellation.

5.4 Condition of Returned Goods

You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functionality, in a similar way to how you would be able to inspect them in a shop.

If goods are handled beyond what is reasonably necessary and their value is reduced as a result, we may be entitled to make a deduction from the refund where permitted by law.

Certain products may be excluded from statutory cancellation rights where an applicable legal exception applies, including certain personalised or customised products.

5.6 Faulty, Damaged or Incorrect Goods

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund under applicable consumer law.

Please include your order number and sufficient information for us to identify the order.

We will provide any relevant return instructions and information required to process your return.

Please do not send returns to our registered or business address unless we specifically instruct you to do so.

7. COPYRIGHT AND INTELLECTUAL PROPERTY

All content on the Website, including text, product descriptions, images, photographs, product photography, graphics, logos, designs, brand names, videos, layouts and other materials, is owned by or licensed to BRYDER and is protected by applicable intellectual property laws.

You may access and use the Website for your personal and non-commercial purposes.

You must not reproduce, copy, modify, distribute, publish, sell, license or commercially exploit any Website content without our prior written permission.

Nothing in these Terms transfers ownership of any BRYDER intellectual property to you.

Subject to the above, we will not be responsible for losses that were not reasonably foreseeable to both you and us when the contract was formed.

Nothing in these Terms is intended to exclude or restrict any rights or remedies that cannot legally be excluded or restricted.

10. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failures caused by circumstances outside our reasonable control.

Such circumstances may include severe weather, natural disasters, fire, flood, war, terrorism, industrial disputes, government action, disruption to transport networks, telecommunications failures, power failures, or failures affecting third-party service providers.

Where such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

You can unsubscribe from marketing communications at any time using the unsubscribe or opt-out method provided in the relevant communication. 

By opting in you agree to receive recurring automated promotional and personalized marketing text messages from BRYDER at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Website, products, services or legal requirements.

When we make changes, we will update the Effective Date at the top of these Terms.

The Terms applicable to an order will generally be the Terms in effect when you place that order, unless a change is required by law or otherwise agreed with you.

If you are a consumer, you will also benefit from any mandatory consumer protections provided by the law of the country in which you live where applicable.
